No fault" compulsory retirement provisions in LLP and partnership agreements can sometimes look deceptively straightforward based on their contractual wording. However, in reality, there are a number of potential arguments that might arise when a firm seeks to retire a partner without cause, including in relation to Braganza, natural justice or discrimination (to name a few). The session will explore how a "no fault" retirement might be constrained by these factors and how those arguments might play out in "real world" examples.
This workshop will be targeted at exploring the fundamentals of partnership law and will be most helpful to those who are newer to the practice, but, subject to places, all levels are of course welcome. We are limited on in person places so please do register ASAP.
At the end of the workshop there will be a drinks and canape reception for approximately an hour and a half to allow Members to meet and network.
